Both Power Line (“Connect the Dots” ), and the Wall Street Journal (“Listening In” ) noticed that it was NSA surveillance of foreign communications traffic that revealed who the German terrorists were leading to last week's arrests.
Citing a report about the arrest in Der Spiegel, John at Power Line points out how, in spite of most Democrats denouncing the NSA program as “unconstitutional,”

If the Democrats get their way, the NSA will not be able to use this tactic unless it has enough knowledge, enough days in advance, to get an order from a FISA judge. You can be sure, however, that the liberals will never mention this incident when they denounce the program as an invasion of constitutional rights..
Democrats in Congress are planning to churn up as much opposition to this as they can in the coming week. Expect once more to hear lots of news references to “domestic spying.”

Success would have been as easily had with a warrant. The real issue is a constitutional check on executive power. A mojority wish to keep it, and a minority would prefer the executive to have dictatorial powers.
You can say it's a war. Well fine, let the president collect intelligence without a warrant then, but don't try to call that evidence in court. Believe it or not, we still need some protection from the government.
Okay ben, I say it's a war and the people we are at war with say it's a war. If you look at how terror cells work and operate in the U.S., you will see the threat of Islam is imminent.
The terrorists understand how you feel about surveillance. They are counting on you to keep them safe. Will you please do a little research on terror cell operations and the Islamic religion.
Our constitution and the right to own a gun will keep us safe from the government, if needed. But, they will not defend us against jihadists - their bombs are being built right now.
